WIN A TRIP TO INDY 2007 COMP
Rules and Regulations:
1. Information on how to enter and prizes forms part of these Conditions of Entry.
2. The Promoter is Brand Collective (ABN Number 53 098 742 708) 300 Lorimer Street, Port Melbourne, VICTORIA 3207 ("the Promoter").
3. Promotion commences 1st August 2007 and continues until 15th September 2007 ("Promotional Period").
4. Entry is only open to Australian and New Zealand residents during the Promotional Period ("Eligible Participants"). Employees and their immediate families of the Promoter, its related bodies corporate and agencies are ineligible to enter. "Immediate family" means spouse, parent, child or sibling, whether or not they live in the same household as the employee.
5. Only completed entries will be accepted. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on the accuracy of their answer to the competition question. Judges' decision is final and no correspondence will be entered into. Multiple entries will be accepted but each entry must be unique. The Promoter will not accept entries by fax or in person. No responsibility is accepted for late, lost or misdirected entries.
6. To enter, Eligible Participants must post their entry to "WIN A TRIP TO INDY COMP" Anger Management, 300 Lorimer St, Port Melbourne, Victoria 2007. Entering the competition requires Eligible Participants to correctly answer the competition questions and to provide a copy of proof of purchase of any Anger Management menswear product from KMART.
7. At 9am (EST), on the 17th September 2007, at Brand Collective's Head Office in Melbourne, the entries with the best entries as determined by the judge will be selected as winners.
8. The major winning prize is A TRIP TO INDY 2007. PRIZE INCLUDES: Return economy airfare to the Gold Coast for 2 people, 4 nights accommodation in a non track room at the Gold Coast International Hotel and general admission, 4 day flexi pass for 2 people to Indy in October
9. Allow up to two weeks for issue of prizes.
10. The winner agrees that the Promoter has the right to use their answer to the Question and their personal details at its absolute discretion for future promotional, marketing and publicity purposes. If the selected winner does not accept these conditions then they will forfeit their chance for the prize and another winner will be selected.
11. The winners will be notified via telephone or email or post published to the website (please indicate preference in your entry).
12. Each entrant warrants to the Promoter that each answer to the Question submitted is the original work of the entrant, which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
13. Prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in the value of the prizes. If for any reason a prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value.
14. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
15. In the event of the Major Prize not being accepted or claimed within 7 days of the draw, the relevant winning entries will be deemed invalid.
16. If for any reason this promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion.
17. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this promotion.
18. All personal details become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion. To do this, the Promoter may disclose your personal information to other companies associated with this promotion. If you do not provide your personal information, the Promoter will not be able to enter you into this promotion. In most cases, you can gain access to your personal information by contacting the Promoter's Privacy Officer on 1800 045 623 or to request a copy of the Promoter's Privacy Policy.
19. All entries become the property of the Promoter.
20. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a consequence of the use and enjoyment of the prize.
